The possibility of lower rates in each category exists if they are consumed by the weaker section of society. ##question-circle## Bodhi Saar Prashn datewise ##chevron-right## 09-05-2017 Finance minister Arun Jaitley said that quarterly filing of returns under the Goods and Services Tax (GST) was not workable for tax payers above Rs.50 lakh turnover because input tax credit has to be given every month. Only small taxpayers, whose turnover is below Rs 50 lakh per annum under the composition scheme, can avail of filing quarterly returns. But these will not be able to avail of input tax credit.  ##chevron-right## 06-04-2017 India’s dream of a ‘one nation one tax' crossed the last hurdle with the Rajya Sabha passing all the four bills related to the Goods and Service Tax (GST) without any amendments. Former Prime Minister and senior Congress leader Dr. Manmohan Singh asked the Congress not to seek changes in the four bills. The long-awaited GST is thus poised to be implemented from July 1, but industry is worried as preparations need a lot of time.   ##chevron-right## 27-03-2017 With the target of rolling out the new indirect tax regime from July 1, Finance Minister Arun Jaitley presented 4 bills related to Goods and Service Tax (GST) – Central GST (CGST), Integrated GST (IGST), Union Territory GST (UTGST) and Compensation law Bill – in the Lok Sabha. Studies estimate that the growth rate could increase by 2% with the implementation of GST. ##chevron-right## 22-03-2017 The Finance Minister has said that GST will increase the volume of taxation, remove the tax on tax situation, and therefore make goods, commodities and services a little cheaper and far more convenient.   ##chevron-right## 21-03-2017 With a target of launching the GST regime from 01 July 2017, the Union Cabinet has cleared four supplementary Goods and Services Tax (GST) legislations which will be introduced in Parliament in the ongoing budget session. A fifth legistaion on amending the Excise and Customs Act will also be brought. The Finance Minister has appreciated that all decisions in the 12 GST Council meetings so far were taken through consensus, and not voting.  ##chevron-right## 12-03-2017 The Central Bureau of Excise and Customs (CBEC) Chairman has said that the inquiry into a probable case of service tax evasion by Goods and Services Tax Network (GSTN) - the company building the IT backbone for the new indirect tax regime - is going on.  ##chevron-right## 10-03-2017 It is feared that since some states may lose out on revenues in the GST regime, as GST is a consumption based tax paid at the point where goods or services are consumed and not where they are manufactured. This would mean that poorer state, they can resort to the provision where a state can challenge and demand a separate tax under GST, even if the amount was paid in another territory. Together with this, the goods and services that would attract a cess on top of the peak rate need to be decided, to create a corpus to compensate states for revenue loss from GST in the first 5 years.  ##chevron-right## 03-03-2017 In a crucial two-days session on 04 and 05 March, the GST Council will try to seek consensus on approvals on iGST (integrated GST), cGST (central GST) and sGST (state GST) drafts before the second half of Parliament's budget session starts on 9 March. To roll out the new regime from 1 July, the two laws - the Central GST (CGST) Act and Integrated GST (IGST) Act - must be approved by the Parliament and each of the state legislatures have to pass the State GST (SGST) Act.  ##chevron-right## 18-02-2017 In a bizarre development, the private company that is developing the GSTN (the I.T. backbone of GST regime),  is under scrutiny for probable tax evasion! The service tax department (under the Central Bureau of Excise and Customs (CBEC)) has issued a summon. Analysts say that grants by government are not subject to Service Tax. ##chevron-right## 18-02-2017 It seems likely that the GST will be rolled out by July, as the GST Council has approved a draft law that seeks to compensate fully the States for revenue losses as a result of GST implementation. Now 3 draft laws are pending to be approved in the next meeting - the C-GST law, the I-GST law, and the S-GST laws. The companies say this will block working capital, and may force sellers to move offline.  ##chevron-right## 06-02-2017  The Finance Ministry has warned all officials that any disagreement with government policies will invite strict action. Various associations of the central govt. tax officers across India (numbering 70,000 officers) have threatened to undertake a non-cooperation movement against the "wrong decisions" of the GST Council regarding division of powers in the GST regime. These CBEC officers are not happy with ceding of taxpayer base to the states! ##chevron-right## 23-01-2017 In a surprise development, a tax officers’ association (All India Association of Group B Central Excise Gazetted Executive Officers) has “warned” the Finance Minister not to implement the GST in a hurry, and to roll back some “illegal” decisions of the GST Council (like transferring 90% of cases less than Rs.1.5 cr to States under GST) else they’ll be forced to take judicial recourse, which will further delay the GST launch, and further dent the already affected GDP (due to demonetization). ##chevron-right## 18-01-2017 The GST Dual Control issue was resolved thus - for all assessees with revenues less than Rs.1.5 cr per annum, states and centre will share the audit and scrutiny in 90 : 10 ratio (random selections).       • ##chevron-right## 20-05-2017 As promised by the Finance Minister in his Budget speech 2017-18, the Central government unveiled a draft law that seeks to confiscate properties of fugitive economic offenders and to remove loopholes to deter offenders from evading Indian law by remaining outside the jurisdiction of domestic courts. It's seen as a measure to deal with cases like liquor baron Vijay Mallya who fled to the UK.  ##chevron-right## 19-05-2017 As expected, the Kulbhushan Jadhav case was a diplomatic victory for India and a political one for the NDA government. Pakistan, as expected, has turned arrogant on the issue questioning the ICJ's jurisdiction. Some fear that Jadhav may have already been executed by the Pakistanis. Meanwhile, strange details emerged about how the UPA government had removed Salve (the winning lawyer for the first stage of this case) in a commercial litigation involving Enron's Dabhol project, in 2004-05, replacing him with Khawar Qureshi (the losing lawyer in the present case!). India lost that case that time.  ##chevron-right## 18-05-2017 The International Court of Justice (ICJ) pronounced its judgment in the Kulbhushan Jadhav case on 18th May, and ruled in India’s favour (at the first stage). The judgment comes ten days after India approached it demanding immediate suspension of the death sentence awarded to Jadhav, surprising Pakistan. India put forward the following provisional measures in its appeal : (1) Declare the death sentence of Jadhav illegal, as it violates the Vienna Convention and Indian law, (2) if Pakistan is unable to annul the decision, direct it to release the convicted Indian national. ##question-circle## Bodhi Saar Prashn datewise  ##chevron-right## 13-05-2017 The International Court of Justice (ICJ) at The Hague announced it will hold public hearings on May 15 in the case of the retired Indian Navy officer who was convicted of espionage charges by a Pakistani military court.  ##chevron-right## 11-05-2017 The Supreme Court began its hearing on six petitions and a suo motu public interest litigation (PIL) that challenged the constitutional validity of Muslim practices such as triple talaq, and nikah halala along with the issue of polygamy. The court declared that it would not decide on polygamy and would limit itself to triple talaq and the consequential question of nikah halala.  ##chevron-right## 11-05-2017 The five-judge Constitutional bench of Supreme Court began its hearing on a plea that the triple talaq and nikah halala violated Muslim women's rights to equality and dignity. Just after the hearing began, Chief Justice of India JS Khehar clarified, "The matter can be summed up in three points: whether triple talaq is fundamental to Islam; if it is fundamental we have to see if we can interfere. Two, whether it is sacramental or not, and three, whether there is an enforceable fundamental right that is violated." Read more on Triple Talaq here ##chevron-right## 10-05-2017 In a dramatic development in the history of Indian judiciary, Calcutta High Court judge, Justice C S Karnan, who is facing contempt charges, ‘sentenced’ CJI J S Khehar and 7 other judges of the Supreme Court to five years rigorous imprisonment. The apex court, on the other hand, held the rebel judge guilty of contempt of court and sentenced him to six months in jail. Karnan is the first sitting judge in India's judicial history to be sentenced to a prison term.  ##chevron-right## 09-05-2017 The Supreme Court ordered that the former Bihar Chief Minister Lalu Prasad Yadav will be tried in each of the remaining five cases against him in connection with the multi crore fodder scam. The ruling came on an appeal by the CBI against a 2014 order from the Jharkhand high court that said Prasad could not be tried for the same crime twice. ##chevron-right## 09-05-2017 Referring to the practice of Triple Talaq, the Allahabad High Court has observed that under the Muslim Personal Law, marriage is a contract which cannot be terminated unilaterally. The HC said all forms of discrimination on grounds of gender violate fundamental freedoms and human rights.   ##chevron-right## 09-05-2017 The Supreme Court accepted a plea by consortium of banks against liquor baron Vijay Mallya. Mr. Mallya would have to face contempt of court proceedings. The apex court has directed Vijay Mallya to be present before it on July 10. Mr. Mallya, who fled from India last year. Mallya owes over Rs. 9000 crore to the banks.

      • ##chevron-right## 18-05-2017 Finance Minister Arun Jaitley said that it is no longer safe to deal with excessive cash as through the use of technology it is easy to detect tax evasion. After having brought 91 lakh fresh taxpayers in the tax net and detecting undisclosed income worth Rs.23,144 crore in the six months after DeMo, the government launched an online portal as an extension of its ongoing initiative of ‘Operation Clean Money’.  ##chevron-right## 15-05-2017 Even after six months since demonetization, some unanswered questions remain - (1) How much old currency was returned to the system in the form of deposits or exchange?, (2) How much black money was uncovered due to the note-ban exercise?, (3) What is the amount of counterfeit notes that came into the government's possession?, (4) What is the status of remonetisation of the Rs 15.44 lakh crore old notes that were made invalid during demonetisation?, (5) How did the RBI weigh the pros and cons of the note-ban move despite obvious disruptions to economic activity?, and (6) How prepared was RBI for the following digital-money push by government post note-ban? The RBI is yet to provide answers to these questions. ##chevron-right## 11-05-2017 The government added 9.1 million new taxpayers in 2016-17, an 80% increase over the typical yearly rise, highlighting the impact of India’s November demonetization of high-value currencies. This is expected to augment the government’s tax revenue. India had only 55.9 million individual taxpayers at the end of 2015-16. But a definite result has been the lowering of interest rates, which was one of the prime objectives. Flushed with funds, banks have been forced to lower deposit interest rates which have made loans cheaper. ##chevron-right## 06-04-2017 The Reserve Bank of India, in its Monetary Policy review meeting  kept the Repo Rate unchanged at 6.25 percent but raised the Reverse Repo rate – the rate which banks get for deposits at RBI – by 25 basis points to 6.0 percent. Narrowing the gap between the two rates reduces volatility in the short-term money market rates. It also controls money circulation, and thereby, inflation, as banks are encouraged to increase their deposits with the RBI. ##chevron-right## 27-03-2017  RBI Deputy-Governor N S Swaminathan said that the Central Bank has no plans to introduce new denomination currencies. He said the Central Bank wants to encourage cashless transactions which are helpful to the people. He also said that NPAs are affecting the incomes and profits of banks. ##chevron-right## 22-03-2017  The Supreme Court has sought the Centre and the RBI's response on why they did not give a window to citizens to deposit demonetised currency after December 31.
