The government is making Aadhar mandatory for increasing number of functions such as mid-day meals at schools, access to primary and secondary education, filing of IT returns, etc. The Supreme Court has specified that Aadhar cannot be made mandatory for any government scheme, but can be used as a voluntary identification for 5 specific government programmes viz. public distribution scheme, National Rural Employment Guarantee Act, National Social Assistance Programme, Jan Dhan Yojana and for LPG subsidies. A public interest litigation is pending in the SC for more than 4 years awaiting final orders. Before making Aadhar mandatory, the government should put in place strong privacy laws to protect citizen’s privacy. Present provisions to prevent misuse are inadequate. Authentication of a person’s identity using Aadhar should be only after getting his/her consent. You can download various Aadhar related docs here, here, here and here.

 The linking of Aadhar to numerous activities would mean that the government can keep a watch on the person’s activities, which may result in infringement of his individual liberty. Private companies can also have access to the consumers’ behavior, health, financial status, payments history and tastes, which could easily be misused. Aadhar also involves online privacy issues. EU has assured its citizens that they have “the right to be forgotten online”. India also needs such a right with adequate legal protection. Not only making laws would be enough, but their effective implementation and enforcement is also necessary. India has a very long way to go. One only hopes no major breach happens in the meantime.
